Claims
Before making a claim against the municipality, it is recommended that you contact your own insurer regarding damages. Depending on the situation, you may be eligible for more compensation from your insurer than you can recover from the municipality. If your insurer believes the municipality is liable, they will contact the Township of Stirling-Rawdon on your behalf.
If you experience property damage, you should notify your insurance company of the loss. Failure to notify your insurer at the onset of the loss may affect your rights to recover costs under your insurance policy.
Note: It is important that you make efforts to minimize damage to your property. If you do not, you may be held responsible for part of the damage.
How to submit a claim:
If you have incurred damage to your property or had an injury, and you believe the municipality may be responsible, you can:

2.Provide written notification to the Township of Stirling-Rawdon, outlining the details of your claim. Send your notifications to:

In accordance with the Municipal Act, we must receive notification in writing. In some cases, you are required to place the Township on notice within ten (10) days of the occurrence.
What is required to start a claim?

The name, mailing address, email address, and telephone number of the person who has incurred an injury or financial loss (the “claimant”);

The contact name, mailing address, email address, and telephone number of the person submitting the claim (if different from the claimant);

The date, approximate time of the occurrence and exact location of the occurrence (address or coordinates with closest intersection, and direction of travel, if applicable);

A brief description of what happened, including photos of the incident, damage, or injury and any invoices supporting any financial loss claimed as a result of the occurrence.
Note: Please submit documents in .jpg or .pdf format.
Important: Missing information will cause delays in the processing of your claim. If you need to submit additional information in support of your claim, please email clerk@stirling-rawdon.com as soon as possible.
In the event that your claim is accepted, an invoice is required prior to the municipality issuing any compensation.
The Municipal Act requires that the municipality receives notification within ten (10) days of the occurrence. We recommend that you inform the municipality as soon as possible if you have incurred an injury or financial loss for an occurrence you believe falls under municipal responsibility.
Note: Payment for property damage or bodily injury is contingent upon the municipality being found legally liable for the damages you have incurred.
Response Time
Your claim will be acknowledged upon receipt; if warranted, an investigation will commence. You may be contacted by staff or the municipality’s insurance adjuster for clarification or further information.
All claims are subject to the same investigation process, and the timeline to carry out the investigations varies.
Compensation
The Township of Stirling-Rawdon will not be held responsible for costs unless you can provide evidence that the municipality committed a negligent act or omission which resulted in injury or damage.
Like most Canadian municipalities, we only provide compensation when we are legally liable for the damage sustained. This approach reduces the costs for the taxpaying public, who ultimately bear the costs of these claims. Fraudulent claims cost all taxpayers. The Township will prosecute all fraudulent claims to the full extent of the law.
The municipality is not responsible for damages if it has met O. Reg. 239/02: Minimum Maintenance Standards for Municipal Highways.
This claims process does not mean the Township of Stirling-Rawdon is accepting liability for your claim, nor does it waive any legal rights that the Township of Stirling-Rawdon may rely on in matters such as these.
